1. Acceptance of Terms

These Terms of Service ("Terms", "Terms of Service") govern your use of our website located at FanVote.us (together or individually "Service") operated by FanVote.

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages. Your agreement with us includes these Terms and our Privacy Policy ("Agreements"). You acknowledge that you have read and understood Agreements, and agree to be bound of them. If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing support@fanvote.us so we can try to find a solution.

2. Voting Integrity & Conduct

FanVote is built on the premise of genuine, honest fan polling. By participating in our service, you agree to the following code of conduct:

• You will not use automated scripts, bots, or any other unauthorized software to submit ballots or interact with the platform.
• You will not create multiple accounts ('burner' or 'alt' accounts) to artificially inflate a team's ranking or manipulate conference data.
• You must genuinely represent the fanbase of the team you select as your favorite. Intentional misrepresentation to manipulate rival rankings is considered a violation of these terms.

We reserve the right to ban accounts, discard ballots, or flag any user we determine, in our sole discretion, to be violating these rules. Team selection is permanent unless a "Team Change" pass is explicitly purchased, to ensure long-term data integrity.

3. Subscriptions, Purchases, & Refunds

We offer premium features and one-time purchases to support the platform:

• Booster/Premium: A monthly subscription offering an ad-free experience, cosmetic badges, and priority access to new features.
• Power Voter: A permanent or seasonal status upgrade that weights your ballot up to 3x in the national consensus.
• Team Change: A one-time digital pass to reset your primary team affiliation.

By placing an order for Products/Services through the Site, you warrant that you are legally capable of entering into binding contracts. All transactions are securely processed by Stripe. Due to the immediate digital nature of these status upgrades and virtual goods, all sales are final, and no refunds will be issued once the service is rendered.

4. Intellectual Property

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, international copyright laws, and international conventions.

5. Disclaimer of Warranties and Limitation of Liability

THE SITE AND THE FANVOTE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES REGARDING THE ACCURACY OF THE POLLING DATA AND CANNOT BE HELD LIABLE FOR THE RESULTS OF ANY POLLS.

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. We are not responsible for any heated arguments, broken friendships, or emotional distress caused by ranking results or rivalry bias scores.
